Hon’ble Bombay High Court Allows MAGGI Noodles to be Exported

At the hearing today the Hon’ble Bombay High Court allowed Nestlé India to continue the export of MAGGI Noodles. The Hon’ble Court has fixed the matter for further hearing on 14th July.
As the matter is sub-judice we cannot make any further comment on the case at this stage. We await the official order from the Hon’ble High Court.
Writ Petition (L) No. 1688 of 2015 - Nestlé India Ltd. V. FSSAI & Ors. heard in the Bombay High Court

The Hon’ble Bombay High Court today heard the petition filed by Nestlé India raising issues of interpretation of the Food Safety and Standards Act and the orders passed by the Commissioner of Food Safety, Maharashtra and the Food Safety and Standards Authority of India (FSSAI).
At the hearing, the company reiterated its press release of 5th June, 2015 and confirmed that it is continuing to remove MAGGI Noodles from the shelf and that the progress reports are being made to the FSSAI. The Hon’ble Court has also directed the FSSAI not to take any action in respect of the notice which required the company to explain itself within 15 days over the product approval already granted for MAGGI Noodles, till the next date of hearing.
The court has asked the Commissioner of Food Safety, Maharashtra and the FSSAI to file their reply affidavits. The court has fixed the hearing for 30th June, 2015.

As part of the effort to resolve the MAGGI Noodles issue, Nestlé India Limited has today approached the Hon'ble Bombay High Court raising issues of interpretation of the Food Safety and Standards Act 2011, whilst seeking judicial review of the Order dated 6th June, 2015 passed by the Food and Drug Administration in Maharashtra and the Order dated 5th June, 2015 passed by the Food Safety and Standards Authority of India (FSSAI).
At the same time we are continuing the withdrawal of MAGGI Noodles products. This action will not interfere with this process.
We shall proceed further as per orders that may be passed by the Hon’ble Bombay High Court.
